Terms and Conditions

Please read these terms carefully before using our services

1 Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and ANGA LUXE TRAVELS ("Company," "we," "us," or "our"), a travel agency registered and operating in Tanzania, East Africa.

By accessing our website, using our services, or making a booking, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our services.

Important Notice

Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations, including limitations and exclusions that may apply to you.

2 Our Services

ANGA LUXE TRAVELS operates as a travel agency and concierge service, providing:

  • Personalized travel planning and itinerary creation
  • Booking of flights, accommodations, tours, and other travel services
  • Travel consultation and advisory services
  • 24/7 concierge support during travel
  • Visa and travel document assistance
  • Special arrangements and exclusive experiences

2.1 Acting as Agent

We act as an agent on behalf of third-party service providers (airlines, hotels, tour operators, etc.). While we carefully select our partners, we do not own, operate, or control these services. Each provider has its own terms and conditions that you must also accept.

2.2 Service Availability

We reserve the right to refuse service, terminate accounts, or cancel bookings at our discretion, particularly in cases of:

  • Fraudulent or illegal activity
  • Violation of these Terms
  • Abusive or inappropriate behavior toward our staff or partners
  • Failure to provide required documentation or payment

3 Bookings and Payments

3.1 Booking Process

To make a booking, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts
  • Provide accurate and complete information
  • Accept the terms of our service providers
  • Agree to these Terms and Conditions

3.2 Pricing

All prices are quoted in US Dollars (USD) unless otherwise stated. Prices are subject to change until full payment is received and booking is confirmed.

Prices include:

  • Services as specified in your itinerary
  • Our professional planning and concierge fees (where applicable)
  • Applicable taxes and service charges (as stated)

Prices do NOT include:

  • Travel insurance (strongly recommended)
  • Visa fees and passport costs
  • Vaccinations and health requirements
  • Personal expenses, gratuities, and incidentals
  • Meals not specified in the itinerary
  • Additional baggage fees

3.3 Payment Terms

  • Deposit: A non-refundable deposit of 30-50% is required to confirm your booking
  • Final Payment: Must be received 60 days before departure (or as specified)
  • Late Bookings: Full payment required immediately for bookings within 60 days of departure
  • Payment Methods: Credit card, bank transfer, or other agreed methods

3.4 Booking Confirmation

Your booking is only confirmed once we receive your deposit and send written confirmation. Verbal agreements or email inquiries do not constitute confirmed bookings.

4 Cancellation and Refunds

4.1 Cancellation by Client

All cancellations must be submitted in writing via email. Cancellation fees apply as follows:

Standard Cancellation Policy:

More than 90 days before departure Deposit forfeited
60-90 days before departure 50% of total cost
30-59 days before departure 75% of total cost
Less than 30 days before departure 100% of total cost

Important Notes

  • • Some services may have different cancellation terms set by suppliers
  • • Peak season travel (December-January, July-August) may have stricter policies
  • • Non-refundable components (flights, permits, special events) cannot be refunded
  • • Travel insurance may cover cancellation fees—we strongly recommend purchasing it

4.2 Cancellation by ANGA LUXE TRAVELS

We reserve the right to cancel bookings due to:

  • Insufficient participant numbers
  • Force majeure events (see Section 9)
  • Safety or security concerns
  • Non-payment by client
  • Unavailability of key services

In such cases, we will offer an alternative travel arrangement or a full refund of amounts paid (excluding non-refundable third-party costs already incurred).

4.3 Changes to Bookings

Changes to confirmed bookings are subject to availability and may incur:

  • Administrative fee: USD $100-$250 per change
  • Supplier change fees and fare differences
  • Price increases between booking and change date

Major changes (dates, destinations, accommodation category) may be treated as cancellations with applicable fees.

4.4 Refund Processing

Approved refunds will be processed within 30-60 days of written cancellation, subject to receipt of funds from suppliers. Refunds will be made to the original payment method.

5 Client Responsibilities

As a client, you are responsible for:

Accurate Information

Providing complete and accurate personal information, passport details, and special requirements

Valid Documents

Ensuring passports, visas, and other travel documents are valid for your entire trip

Health Requirements

Obtaining required vaccinations and health documentation

Travel Insurance

Obtaining comprehensive travel insurance (strongly recommended)

Punctuality

Arriving on time for all scheduled services and transfers

Respectful Conduct

Behaving respectfully toward local communities, staff, and other travelers

5.1 Fitness to Travel

You must inform us of any medical conditions, disabilities, dietary requirements, or special needs that may affect your ability to participate fully in the arranged activities. We will make reasonable efforts to accommodate your needs, but some activities may not be suitable for all travelers.

5.2 Compliance with Laws

You must comply with all local laws, customs, and regulations of the countries you visit. We are not responsible for any consequences arising from your failure to comply with local laws.

6 Travel Documents and Entry Requirements

It is your responsibility to ensure you have all necessary travel documents, including:

  • Passport: Valid for at least 6 months beyond your return date
  • Visas: Obtained for all countries you will visit or transit through
  • Vaccinations: Yellow fever, COVID-19, and other required immunizations
  • Health Documents: Medical certificates, vaccination cards as required
  • Travel Insurance: Proof of coverage (where required)

Critical Warning

While we provide general guidance on visa and entry requirements, it is YOUR responsibility to verify requirements with the relevant embassies and consulates. Requirements change frequently. We are not liable for denied entry, deportation, fines, or other consequences resulting from inadequate documentation.

7 Limitation of Liability

7.1 Acting as Agent

ANGA LUXE TRAVELS acts solely as an intermediary agent arranging services provided by independent third parties (airlines, hotels, tour operators, transport companies, etc.). We do not own, operate, or control these services.

We are not liable for:

  • Acts, errors, omissions, or defaults of third-party service providers
  • Flight delays, cancellations, or schedule changes
  • Hotel overbooking, service quality, or facility issues
  • Loss, damage, or delay of baggage or personal property
  • Personal injury, illness, or death caused by third parties
  • Strikes, labor disputes, or service interruptions
  • Weather conditions or natural disasters

7.2 Maximum Liability

To the maximum extent permitted by Tanzanian law and international conventions, our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the booking in question.

7.3 Exclusion of Consequential Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of enjoyment or vacation time
  • Emotional distress or mental anguish
  • Lost business opportunities or income
  • Additional expenses incurred due to service failures

Protection Through Insurance

We strongly recommend purchasing comprehensive travel insurance to protect yourself against unforeseen circumstances, cancellations, medical emergencies, and other travel-related risks.

8 Travel Insurance

Travel insurance is STRONGLY RECOMMENDED and may be mandatory for certain destinations or activities.

Your insurance should cover:

  • Trip cancellation and interruption
  • Medical expenses and emergency evacuation
  • Lost, stolen, or damaged baggage
  • Flight delays and missed connections
  • Personal liability
  • Adventure activities (if applicable—safaris, climbing, water sports)

Why Insurance Matters:

Medical Emergencies: Medical treatment and evacuation in remote areas can cost tens of thousands of dollars

Trip Cancellation: Protects your investment if you must cancel for covered reasons

Supplier Default: Coverage if a hotel, airline, or tour operator goes bankrupt

COVID-19: Many policies now include pandemic-related coverage

We can recommend reputable insurance providers, but the decision to purchase and the adequacy of coverage is your responsibility. We are not liable for any losses you suffer that would have been covered by adequate insurance.

9 Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, volcanic eruptions)
  • Pandemics, epidemics, or health emergencies
  • War, terrorism, civil unrest, or political instability
  • Government actions, travel restrictions, or border closures
  • Strikes, labor disputes, or transportation failures
  • Supplier bankruptcy or cessation of operations
  • Technical failures or cyber attacks

In force majeure situations, we will make reasonable efforts to provide alternative arrangements or refunds for recoverable costs, but we are not obligated to do so and are not liable for any consequential losses.

COVID-19 and Travel Restrictions

Travel restrictions, quarantine requirements, and entry conditions can change rapidly. We will inform you of known requirements at the time of booking, but you are responsible for monitoring and complying with current regulations. Cancellation policies apply even in cases of travel restrictions—insurance with pandemic coverage is strongly recommended.

10 Intellectual Property

All content on our website and in our materials (text, images, logos, designs, itineraries) is owned by ANGA LUXE TRAVELS or our licensors and is protected by Tanzanian and international copyright and trademark laws.

You may not:

  • Copy, reproduce, or distribute our content without written permission
  • Use our logo, branding, or trademarks
  • Create derivative works from our materials
  • Use our itineraries for commercial purposes

Custom itineraries created for you are for your personal use only and remain our intellectual property.

11 Dispute Resolution

11.1 Complaints

If you have a complaint about our services, you must notify us in writing:

  • During Travel: Immediately, so we can attempt to resolve the issue
  • After Travel: Within 30 days of your return

Failure to notify us promptly may affect our ability to investigate and resolve your complaint.

11.2 Negotiation and Mediation

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation fails, we agree to attempt mediation before pursuing legal action.

11.3 Arbitration

Any disputes that cannot be resolved through negotiation or mediation shall be resolved through binding arbitration in Dar es Salaam, Tanzania, in accordance with the Tanzanian Arbitration Act, unless otherwise agreed by both parties.

12 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Tanzania, and both parties consent to the jurisdiction of such courts.

Where international conventions apply (such as the Warsaw Convention, Montreal Convention for air travel, or Athens Convention for sea travel), those provisions shall take precedence to the extent they conflict with these Terms.

13 Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with an updated "Effective Date."

Material changes will be communicated to clients with existing bookings via email. Your continued use of our services after changes constitutes acceptance of the modified Terms.

For bookings made before changes take effect, the Terms in place at the time of booking will generally apply, unless changes are required by law or for safety/security reasons.

Additional Provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any written booking confirmation, constitute the entire agreement between you and ANGA LUXE TRAVELS regarding our services.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to any successor entity.

Third-Party Rights

These Terms are for the benefit of you and ANGA LUXE TRAVELS only. No third party shall have any rights to enforce any provision of these Terms.

Acknowledgment and Acceptance

By making a booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You also acknowledge that you have been advised to obtain travel insurance and that you understand the cancellation policies and limitations of liability set forth in these Terms.
